Submission of a report depends upon the Hoensee's recognition of the significance of the information. The proposed revision to section 150.20(b) would require that when an Agreement ' State licensee is operating within NRC's jurisdictiers under the general license granted. by 5 150.20, the licensee is subject to the above requirements under Parts 80, 40, and 70. A. JUSTIFICATION 1. Need for the CoDection of Information. Accurney and Te trightness in communications to the NRC by Heenaces and J appHcants' for Hoenses are essential if the. A gency Use of Information.- Information required to be submitted. wn be used by the commission to make decisions cortoerning such matters as the ' granting of licenses to applicants, the issuance of orders to Heensees to correct deficiencies or wrongdoing,.

(, revocation of licenses, the initiation of. inspections and/or investigations, the assessment of civil penalties, the referral of j wrongdoing -to the Department of Justice, and other ' corrective 1 actions, as ' appropriate. Without ' reports by appHeants' and licensees of information with.. significant or safety or common defense or security implications, the NRC' will be severly restricted in its abuity to assure the protection of the pubHc health and safety and the common defense-'as required under the Atomic Energy Act of 1954, as amended, and the Energy Reorganization Act of 1974, as amended. 3. Reduction of Burden Through Information Technology As -the reports under these sections are required on a case,. incident basis

and, therefore are not expected to be routins, improved information technology is currently not considered to be applicable. -

However, there are no legal or administrative obstacles to its use if so desired by any respondent. 4. Effort to Identify Duplication. The requirement to submit ' reports pursuant - to 55 30.9(b). 40.9(b), 50.9(b),. 55.6(b), 60.8a(b), 61.8a(b), 70.9(b), 71-6a(b), 71.9(b), 72.9a(b), 110. Because the required information is inc! dent or situation unique, similar information is not already available. 6. Effort to Reduce Small Business Burden.- The requirements apply to small businesses. However, the required reports are gensrated because ' of actions or failures toCaet by those. same businesses. Therefore, to a great extent they control the need to_ make such t reports. The burden cannot be further reduced if the NRC is to meet its statutory obHgstions described above. 7. Consequences of Less Frequent Collection.- The collection frequency is dictated by events. and the applicant ' or - licensee. The reporting frequency cannot be reduced if the' NRC is to meet its statutory obHgations described above. 8. Circumstances Which Justify Variation From OMB Guidelines. r=p2 ding on the actions of Indiviidual applicants and Hoensees, required reports may be generated by them more ' frequently than quarterly.
