j Gentlemen:

l Your letter to me dated June 26, 1987, requested the Commission's response to the following question:

1 "When a utility imposes the provisions of 10 CFR 21 in a purchase 1

l-order for pumping equipment or finished parts thereof, specified by the utility as Nuclear Safety Related, is the Contractor l-obligated to pass on the same provisions to subsuppliers of raw or finished items that the Contractor's Engineers have determined to be non-critical to equipment operability, or whose failure will not result in imediate catastrophic failure of the pump or in the l

case of an installed pump component, the entire assembly?"

j The requirements of Section 21.31 of 10 CFR Part 21 state that the regulation must be specified in procurement documents for a basic component. A basic I

component is a part or component defined in Section 21.3.(a) of CFR Part 21 and includes pressure retaining material constructed in accordance with Section l

III of the ASME Code or identified by the customer as " safety related." For i

those components which do not satisfy the definition of basic component in i

Section 21.3(a) of Part 21 or the customer does not specifically call out the application of Part 21, the requirements of 10 CFR Part 21 do not have to be i

passed on'to subtier vendors. However, if the customer calls out the applica-tion of Part 21 the requirements must be passed down even though the Contractor's Engineers have determined the items to be non-critical to equipment operability, i

or whose failure will not result in immediate catastrophic failure of the pump.
