NRC STAFF'S RESPONSE TO APPLICANTS' MOTION FOR SCHEDULE OF LITIGATION OF MASSACHUSETTS PLAN On September 21, 1987, the Applicants filed a " Motion for Schedule for Litigation of Massachusetts Plan" (" Motion"), in which they requested that a schedule be established for litigation of the " utility plan" which they submitted three days earlier, for Massachusetts portions of the Seabrook plume exposure pathway emergency planning zone (EPZ).

Nowhere in their Motion do the Applicants propose any particular schedule; rather, they reauest that such a schedule be established

" consistent with the incumbent duties upon the Board and the parties arising out of the already scheduled litigation of the New Hampshire Radiological Emergency Respcnse Plan."

The NRC Staff does not oppose App!! cants' request for establishment of a schedule for litigation of their Massachusetts plan.

However, the Staff suggests that the establishment of such a schedule be deferred for the present time, in light of (a) the Appeal Board's recent remand for further litigation of certain low power issues ( A LAB-875, October 1, 1987); and (b) the active litigation schedule now facing the Board and 9710t%$$$

in view of the higher priority of these other matters and the intensive effort that will necessarily attach to their resolution, and inasmuch as the Staff and FEMA have not yet agreed upon a review schedute for the Applicants' Massachusetts plan, any schedule that may be established at this time for litigation of the Massachusetts plan is likely to be unrealistic and premature.
