PROPOSED IMPOSITION OF CIVIL PENALTY - $25,000 This is to inform the Commission that a Notice of Violation'and Proposed Imposition of Civil Penalty in the amount of Twenty-Five Thousand Dollars _($25,000) will be issued on or about March 2,1989 to Arkansas Power and Light Company. This action'

.is based on failure to control an individual'.s occupational-exposure to less thar, 3 rems per calendar quarter and failure to perform adequate surveys to identify radiation sources (apparently hot particles on,the floor and a contaminated inspec-tion cover gasket) that resulted in an individual exceeding the quarterly whole body radiation exposure limits. The mitigation / escalation factors in the enforcement policy were considered and the base civil penalty amount was decreased by~50%.

'Hitigation given for good past performance, identification and' corrective action was-balanced against prior knowledge. Additional-violations involving ^an overexposure to.the skin due to the presence of a hot particle and a failure to properly instruct personnel in precautions to minimize exposure were not assessed a civil penalty..

It should be noted that the licensee has not been'specifically informed of the enforcement action. The schedule of issuance and notification is:-

Hailing of Notice March 2, 1989 Telephone Notification of Licensee March 2, 1989 The State of Arkansas will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
