l APPENDIX A i NOTICE OF DEVIATION Nebraska Public Power District Docket: 50-298 Cooper Nuclear Station Operating License: DPR-46 Based on the results of an NRC inspection conducted January 1 through February 5,1989, a deviation from your commitments to the NRC was identified.

The deviation consisted of a failure to seal or lock instrument valves. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988), the deviation is listed below:

Failure To Seal Or Lock Instrument Valves  ;

i Updated Safety Analysis Report (USAR)Section VII.2.5, " Inspection and l Testing," prescribes a procedure for conducting calibration tests of reactor protection system channels. This procedure delineates the operation of 1 instruments used for sensing reactor pressure and reactor water level. The USAR states, in part, "The test is conducted as follows:

1. An instrument technician following instructions of authorized personnel unlocks or cuts the seal on instrument shutoff valves to a specific instrument and shuts off the instrument line . . .

8. The calibration signal is then reduced to zero, the test is removed, the calibration taps plugged, the sensors valved into service, and the valves sealed or locked in their operating positions." l In deviation from the above, the instrument shutoff valves for sensing reactor pressure and reactor water level were not sealed or locked as committed to in the USAR. Nebraska Public Power District is hereby requested to submit a written statement or explanation to this Office within 30 days of the date of the letter transmitting l this Notice. This reply, should include for each deviation: (1) the reason for the deviation if admitted, (2) the corrective steps that have been taken and the results achieved, (3) the corrective sters that will be taken to avoid further deviations, and (4) the date when full compliance will be achieved.

Where good cause is shown, consideration will be given to extending the response time.
