Q SYNOPSIS ,

On September 13, 1985, the Regional Administrator, Regi I,requesedthatan Inquiry be initiated concerning alleged intimidation f/a Bartlett \ Nuclear, Incorporated (BNI), Senior Health Physicist (HP) chnician involved in protected activity at the Peach Bottom Nuclear Ge erating Station (PBNGS),

Delta, Pennsylvania. The Philadelphia Electric C gny(PECO)isthe. licensee who contracts with BNI for HP technicians. The nqui y was changed to a full j investigation after the technician's employment was te ina d at the PBNGS on i October 4, 1985, allegedly as a result of his invol m t in protected

! activity.

  • The allegation was received by the NRC op Augus 2,19p5(fromanindividual (source) employed at the PBNGS who requested tha hi ide tity remain confi-dential. The source identified B HP'technici , herei after referred to as the alleger, as being i volye[d in an incid March , 1985, in the PBNGS, Unit 3 recombiner o gas tunn 1 whe n he y have received an over-exposure. The source indica ed the a le er, after iscussing his concerns )

with both BNI and PECO supe'r ision, as threatened with dismissal if he further pursued his radiological concerns.

In response to the allegation, the NR Region I nducted a special unannounced inspection at the PBNGS, Unit 3, 6,n ugust 6-7, 1985, addressino, among other things, the tphnTeaT IrKts of th arch 1,1985, incident in the Unit 3 recombiner FFfgas tunnel. Asgart ' nspection, the Region I inspectors intervieAd the alleger and informe 01:RI there may be some substance to the ir)t'imidation allegation. The i spector said the alleger appeared to be very char / apprehensive about the intery ew and refrained from making any direct bsequent interviews with licensee management personnel revealed tha[ges. they be ved the alleger was the person who had caused the NRC special inspection by cdAtacti:ig Regico I.

l The Region ! Inspection Report documented that no overexposure occurred during

the March 1, 1985, inbident. However, the Inspection Report noted that "no i evidence" was found tohupport the conclusion in the licensee's Discrepancy Report that the alleger's survey s meter had malfunctioned due to muisture and high humidity and no overexposure t had occurred. Subsequent interviews with  !

the alleger, BNI, and PECUJsupervisors determined that several days prior to  !

the NRC unannounced inspectio i alleger and his supervisor on,h, twoPECO supervision occasions andhis to discuss management concerns. met with the At the J l second meeting, the PECO Senior HP told the alleger that he had not received an overexposure and that hij survey meter had gone offscale as a result of a temporary malfunction caused by moisture and high humidity. testified he thought the explanation "was a bunch of bull" but did not dispute  !

l the explanation'becaus2 he " thought he might get fired over the whole matter." '

The PECO Field HP Supervisor testified that he reviewed the Discrepancy Report

'in ;early August,1985 and he did not think the evaluation was accurate.  ;

However, he said he did not dispute the evaluation with the PECO Senior HP, his boss. The PECO HP Field Supervisor also disclosed that in August 1985, he overheard.the PECO Senior HP exclaim to an ur, identified individual over the phone, "[The alleger) is an asshole and shouldn't be here." This testimony was not disputed by the PECO Senior HP who indicated the reason for the comment was because he was dissatisfied with the alleger's inability to grasn  ;

the technical explanation he provided to the alleger concerning the March 1 offgas tunnel incident. The PECO Senior HP indicated his perception of the alleger was, in part, due to his belief that the alleger had contacted the NRC subsequent to their meeting which he felt answered the alleger's technical concerns.

The PECO ALARA Supervisor, who had attended the aforementioned meeting, testified that after the departure of the alleger and his BNI supervisor, a discussicn ensued between himself, the PECO Field HP Supervisor, and the PECO Senior HP. According to the ALARA Supervisor, they discussed the " chances" of the alleger going to the " Commission" and the " bottom line result of the discussion" was that they would not terminate the alleger's employment at this time. The ALARA Supervisor further stated that during this same time period, he was present when the PECO Senior HP questioned whether PECO could use the alleger effectively as an HP if he went to the " Commission."

The Bri: Assistant Site Coordinator testified that shortly after the afore-mentioned meeting, the PECO Senior HP told him, "I want [the alleger) to go in the first group of lay offs." The PECO HP Supervisor testified he.did not "think" he made the above statement. However, he said he did question the alleger's technical ability with his subordinates, the Field HP SupeWisor and/or the ALARA Supervisor, and told them that he was not so sure .that the clieger was what PECO needed at the Peach Bottom station.

In mid September 1985, PEC0 held a third meeting with the alleger and the Bartlett Site Coordinator. The Superintendent of Plant Services testified he requested this meeting to inform the alleger that he should bring his problems to PECO uppe management (Superintendent / Station Manager) if they were not i resolvui by lower level supervision. Testimony from those who attended this meeting indicates that PEC0 management informed the alleger that he should take his concerns up through his chain of command before taking them to the NRC.

l The alleger testified that within days of the above mentioned meeting, the BNI Site Coordinator informed him that he was being laid off effective October 4, ,

1985 because of "too many sick days." The alleger opined that his lay off was {

a result of his pursuing his exposure concerns. The BNI Site Coordinator l

testified that the PECO Field HP Supervisor directed him to lay off the i alleger and one other BNI technician for "too many sick days." A review of Be,rtlett Nuclear personnel records and interviews with PECO supervision /

management determined that the PECO Field HP Supervisor had targeted seven BNI i

I technicians to be laid off for, what he identified as, excessive sick day ab.senteeism (11 days or more during a nine month period). The PECO Field HP i Supervisor termed 11 days of sick leave during a nine month period as "a j glaring excess of absenteeism." However, only three of the seven technicians '

were laid off. Between September 8 and November 1, 1985, 28 Sartlett techni-cians lef t employment at the PBNGS. Only three of these tenninations were l based solely on excessive use of sick days. Interviews with onsite BNI i

l supervisors and the PECO ALARA Supervisor determined that PECO lay offs of Bartlett technicians based solely on sick day absenteeism was inconsistent  !

with the current and past reduction-in-forces (RIF) at the PBNGS.

Th'e Peach Bottom NRC Resident Inspector advised that sometime prior to the current Rif - the PECO field l'P Supervisor infomed him that the upcoming RIF ~

of BNI HP technicians would be based on job performance.

The BN! Assistant Site Coordinator described the elleger as "a good HP" who missed "more than a normal amount of attendance." He said the alleger did a

" nice job" and that he did not have any problems with the alleger's " work performance." He could not recall ever having to counsel the alleger about absenteeism and there was nothing in the alleger's personnel file to indicate absenteeism had been identified as-.a problem. He further testified that sometime during'the Sumner of.1985, the PECO Field HP Supervisor questioned -

him about the alleger's work performance at which time he related the same favorable comments adding that he had missed more than the nomal amount of i l work days. Additional interviews of BNI and PECO HPs did not produce any derogatory infomation relating to the alleger's job perfomance.

J The PECO Field HP Supervisor testified that when the current RIF began in early September 1985, his goal was to lay off two to four people per week. A review of Bartlett Nuclear personnel records reflect, for the most part, this goal was followed with an exception being the week cf September 29 through October 6,1985, the week the 611eger and one other BNI technician were terminated for excessive use of sick days. During this week, eight other BNI HP technicians were either terminated for cause, resigned or accepted a voluntary lay off. Two other BNI technicians attempted to resign but agreed-to work orse additional week at the request of the PECO Field HP Supervisor.

In addition, four new Bartlett technicians were hired by the PECO Field HP Supervisor.

The PECO Superintendent of Plant Services testified that during September 1985, the Field HP Supervisor informed him "that when HP technicians either resigned or were otherwise terminated, they would not be replaced unless there  ;

were some special qualifications" the new hire had which PECO needed at the j time. He said he was not aware of four new hires or the specifics of the l

l other personnel changes which took place during the week the alleger was laid  ;

off. Interviews determined that the four new technicians did not possess any special qualifications. <

l Testimony of the Field HP supervisor indicated ht knew the PECO Senior HP did .

not want the alleger working at PBNGS. However, he said the alleger's lay off  !

was his decision and he did not "believe" that the alleger's temination was a disciplinary act for engaging in NRC protected activity.

The PECO Senior HP testified that it was "cor.,ceivable" that the PECO Field HP Supervisor directed the alleger be laid off because he knew the PECO Senior HP was dissatisfied with the alleger's "technicai ability or inability."

Testimony of PECO management indicates the alleger's employment termination was due, in part, to their perception that the alleger had contacted the NRC which left them with the impression that the alleger was not capable of understanding basic technical aspects of his job because they felt his con-cerns had treen addressed prior to the inspection. However, testimony from both PECO and BNI supervisors document that PECO had contemplated terminating l

- o the alleger's employment prior to being notified of the unannounced NRC inspection on August 6-7, 1985.

The testimony and . documentary evidence obtained during this. investigation conclude that, but for his " protected activity," the alleger's employment at the PBNGS would not have' been terminated by BNI (at PECO's request) on October 4,1985, in violation of :10 CFR 50.7.

During the course of this investigation, a second allegation was brought' to the NRC's attention concerning possible discriminatory acts directed at the .

alleger by PECO relating to his attempts to gain employment.at another nuclear facility. .This allegation was proven to be unfounded, i

Gutierrez, Regional Attorney and J. Allan, Deputy Regional Administrator, I have reviewed the subject Report to determine if confidential information and information that may affect any ongoing 01 investigation should be deleted. I found that this Report does not contain such information. However, I have not reviewed the Report for proprietary and personal data as I do not believe that this office has the expertise to address this area. I recommend that, prior to transmission of the Report to the licensee or placing the Report in the Public Document Room, the Region ensure that an appropriate review be conducted for proprietary and personal data that, by law, should be excised from the Report.

Additionally, I reconrsend that any release of the Report by the Region not include exhibits to the Report.

Further, I suggest t4st in the. future, if such a request is considered, that early coordination with the NRC FOIA office to ensure that the Report is properly excised.

Enclosed is a Report of Investigation concerning the captioned subject. The I investigation sought to detemine if the employment of a Bartlett Nuclear Inc.

(BNI), contract Senior Health Physicist (HP) was terminated at the PBAPS as a result of his e"l,ging in a protected activity. A second objective of this investigation was to determine if the BNI HP was " blackballed" following his J i

termination from PBAPS when he attempted to gain employment at another nuclear facility. l i

I The investigation disclosed that the BNI HP did have legitimate radiological  !

l concerns stemming from an incident which took place in the PBAPS, Unit 3,

! recombiner offgts tunnel on March 1,1985. Testimonial and documentary l evidence indicates that: the licensee's investigation into the matter was l inadequate; it was comon knowledge that the BNI HP had contemplated taking I his concerns to the NRC due to his dissatisfaction with the licensee's investi-gation; the licensee had contemplated and even directed that the BNI HP be i

laid off prior to the incident being reported to the NRC by a source l l (C0hFIDENTIALITY GRANTED); following the NP.C inspection into the matter, licensee management and supervisory personnel wrongly assumed that the BNI

~ technician had contacted the NRC; the BNI technician's employment was subsequently terminated at the direction of the licensee for excessive use of sick days; his temination was selective in that it was contrary to past and current reduction-in-force methods; but for his protected activity, the BNI HP's employment at PBAPS would not have been terminated.

There was insufficient evidence developed to substantiate the latter allegation ,

that the BN! HP was " blackballed" in his attempts to gain employment at other I MRC licensed nuclear facilities. l This Report closes Ol's investigation of this matter. Neither this memorandJm j nor this Report may be released outside the NRC without permission of the i Director. 01. Internal NRC access and dissemination should be on a need and right-to-know bpsis.
