February 20, 1989 SEACOAST ANTI-POLLUTION LEAGUE'S TRIAL BRIEF ON THE SEABROOK PLAN FOR MASSACHUSETTS COMMUNITIES-("SPMC")

The Seacoast Anti-Pollution League (SAPL) intends to litigate Contentions Ji 46, JI 55 and Ji 57 during the first phase of the SPMC l i t i ga t i on.

SAPL will be bringing no direct tes timony and will litigate by cross examination of witnesses.

4 CONTENTION 46 Contention 46 states:

The SPMC fails to provide reasonable assurance that adequate protective measures can and will be implemented for all those persons who are patients in the two hospi tals l

within the Massachuset ts EPZ and for those who become inj ured during the emergency, from radiation j

contamination / exposure. The SPMC theref ore f ails to comply wi t h 10 CFR 50. 47 (a )(1), 50.47 (b)(12 ) and NUREG 0654, Rev.

1, Supp.

1, II.J.10.d, 10.e, 10.g; and II.L.

SAPL's position on this contention is that the SPMC has failed to provide adequate means of public protection for those persons in EPZ hospitals because there is no realistic plan for sheltering or 3

l evacua t ion o f pat lents f rom Amesbury Hospital or Anna Jacques Hospi tal and there are no adequate host f acili ties to receive and treat those patients.

Fur ther, SAPL plans to show that the hospitals identified in the SPMC for medical treatment of evacuees are not adeq ua t e ly prepared to treat the numbers of emergency workers or general public evacuces who might be referred to those hosgitals under various accident scenarios.

Finally, SAPL intends to show that the means of transport of general public evacuees to medical facilities are i

highly insufficient.

CONTENTION Jl 55 Contention JI 55 states:

The SPMC fails to provide reasonable assurance that an adeq ua t e number of buses, ambulances, wheelchair vans, vans, tow trucks, drivers and road crews can and will respond in a timely f ashion. Therefore, t he S PMC v i o l a t e s 10 CFR 50.47(a)(1),

SAPL intends to establish that there is no solid, basis for expecting that the number s of emergency vehicles and drivers relied upon under the SPMC can in reality be relied upon to provide services. - _ - _ _

The SPMC falls to provide adequate means for the handling and disposal of contamina ted was te wa ter and contamina ted materials, contrary to the requirements of 10 CFR

SAPL intends to show that the means for handling waste water and contaminated materials are so unwieldy, cumbersome and ill-conceived that they will encumber the emergency response

effort, cause h

inappropriate hazards to evacuees and delay the process of decontaminating evacuees in a manner that is a detriment to public safety.
