MASSACHUSETTS ATTORNEY GENERAL'S MOTION FOR DIRECTED CERTIFICATION _OF LBP-89-8 The Massachusetts Attcrney General

(' Mass AG') bit.eby moves for directed certification and interlocutory review of LBP-89-8, the Licensing Board's February 16, 1989 Memorandum and Order (Ruling on Motion for Sunnary Disposition of Joint Intervenor Contentions 44A and 44B) (the " Decision").

In that Decision, the Board has ruled that under Massachusetts icw, the Governor of Massachusetts is permitted to delegate the requisite legal authority to the utility's offsite response organization to permit implementation of the utility plan for Seabrook in accordance with Mode 2 of that plan.

In support of this motion, the Mass AG states:

1)

The determination of the legal issues in the Decision will affect the basic structure of the ongoing proceeding in a pervasive or unusual manner.

Public Service-Company of Indiana, (Marble Hill Nuclear Generating Station, Units 1 and 2),

ALAB-405, 5 NRC 1190, 1192 (1977).

2)

The rulings of the Board are incorrect as a matter of Massachusetts law and timely reversal will result in judicial efficiency and economy.

The Mass AG requests that he be permitted to file a Memorandum in support of this Motion setting forth in detail further grounds for it on March 1, 1989.

The Decision was received by the Mass AG on February 17, 1989.

Because of the intervening filing obligations of this office -- testimony on the SPMC plan contentions was filed on February 21, 1989 --

there has not been sufficient time to review the Decision and prepare a brief in support of this motion.

However, because of the importance of this Decision to the structure of the ongoing Ser. brook litigation, interlocutory review should lie.

The Mass AG files this motion today without the necessary support because he realizes that the matter is time-sensitive.
