MOTION FOR EXPEDITED REVIEW OF LBP-88-32,1N REGARD TO ALAB-905 ISSUE NOW COMES the Seacoast Anti-Polluti,on League (SAPL) and moves that the Appeal Board expedite review of the Partial Initial Decision (hereinafter "P.I.D.")

for Seabrook Station, Units 1 and 2 [ sic] of December 30, 1988, insofar as the P.I.D. upholds approval of the New Hampshire Radiological Emergency Response Plan (NHRERP) on the basis of its utilization of the 20 percent evacuee attendance figure for the so-called " reception" centers.

In ALAB-905, issued November 29, 1988, the Appeal Board struck down a 20 percent assumption for reception centers as without foundation and held that the number of evacuees to be planned for at reception centers should be determined on a site l

1 review ALAB-905, as a result of which ALAB-905 is now the final decision of-the NRC on this issue.

In view of the Commission's decision not to review that decision, SAPL believes that the portion of the Seabrook P.I.D.

dealing with the issue of the adequacy of the reception centers involves manifest error, will be reversed and further proceedings on remand may be required.

(Alternatively,.SAPL believes this Board could simply reverse, but there is no precedent for this).

Accordingly, it would be desirable to have the earliest possible appellate consideration of this issue, so as to minimize any delay in undertaking any further proceedings necessary to arrive at a legally defensible decision on this aspect of the NHRERP.

WHEREFORE, SAPL moves as follows:-

1.

The Appeal Board accept the attached brief in support of reversal of LBP-88-32 in light of ALAB-905, without prejudice to the filing of a further SAPL brief on other issues arising out of the P.I.D.

on or before March 24, 1989, as permitted by the Appeal Board's prior scheduling order.

2.

Expedite review of the issue by calling for opposing.

briefs within ten (10) days of the granting of this motion.

3.

Decide the issue of reception center adequacy on the basis of the briefs; and i l

Reverse, on the basis of ALAB-905, the P.I.D. decision in. regard to the adequacy of ' the reception ' centers as provided for under the NHRERP.
