The' Commission was briefed by the staff on a proposed final rule (described in SECY-89-030, released to the public at-the meeting) on. requirements and standards for the establishment and. maintenance of fitness-for-duty programs and procedures.by the licensed nuclear power industry.
The commission requested the staff to report on the. status of fitness-for-duty programs and to revisit the need for changes to the rule 18 months following the effective implementation date of the rule.

Chairman Zech requested the staff to advise the Commission.on the need to expand the fitness-for-duty rule to cover fuel facilities and other material licensees.

-Commissioner Rogers requested the General Counsel to comment on NRC's authority to limit the utilities' use of the test samples for other purposes than required by the rule (e.g., pregnancy analysis, etc. ).

, The General Counsel recommended the addition of language to the statement of consideration in the final rule to make it clear that the Commission has the authority to bring enforcement actions against any of its licensees it a fitness for duty issue could raise health and safety or common defense and security concerns.
