-1. PROGRESS REPORT This progress report is pryered in response to the Licensing Board's "Memorendum and Order (Progress Report and Notice of Available ,

Documents)" dated June 6,1986, and covers the period August 1,1987 through August 31, 1987. The next report will cover the bimonthly period September 1,1987 through October 31,.1987.

1. DISCOVERY There has been no change in the status of discovery since the Steff's last Progress Report.

2, CONSTRUCTION PERMITS The Atomic Safety and Licensing Appeal Board issued a decision on June 30, 1987 resolving the Staff's and Applicarits' first and second appeals in the Comanche Peak Steam Electric Station (CPSES), Unit 1, construction permit extension proceeding. affirmed the Licensing Board's admission of Amended Contention 2, stating that the Consolidated Interveners had provided sufficient basis for the claims in the Amended Contention that Appilcants had a policy to deliberately ignore or violate NRC requirements, and that the policy had not been actually repudiated by the Applicants. On July 17, 1987 Applicants petitioned the Commission for review of the Appeal Board decision. Commission action on Applicants' request is pending.

The Appilcants' April 29, 1987 request for an extension of the latest construction completion date of Construction Permit CPPR-127 for CPSES, Unit 2, is still under Staff consideration. On August 25, 1987. the Staff requested additional informat'lon regarding groundwater withdrawal rates at the site, as well as groundwater declines in the area surrounding the l

site. Groundwater withdrawal for CPSES construction is limited by a j condition in the construction permits, as amended.

3. OPERATING LICENSES On August 20, 1987 the Applicants filed a motion before the Licensing Board for establishment of a schedule for the identification and litigation of matters that remain to be resolved ut1 der Contention 5. The Staff is currently reviewing the Applicants' proposal and plans to file a response during the next reporting period.
4. _ STAFF REVIEW AND EFFORTS The Staff is currently reviewing the information obtained at the public meeting with the Applicants on July 29 and 30, 1987 and subsequent submittals by the Applicanty on the relationship between the

l t Comanche Peak Response Team (CPRT) and the Corrective Action Program ,

l l (CAP) (August 20, 1987) and a detailed description . of the CAP which included process flow diagrams for its various topical areas ( August 28, 1987). The Staff is using this information to finalize a comprehensive review and Inspection approach for Comanche . Peak licensing activities.

Staff review and evaluation of the high priority licensing items ilsted in the sixth Progress Report is ongoing. On August 5,1987 the Staff and Applicants met to discuss the status of Comanche Peak technical specifications (TS) development (see Meeting Summary dated August 1, 1987). As agreed at this meeting, the Staff transmitted a copy of the current Westinghouse Standard Technical Specifications (STS) to the l Applicants on August 14, 1987 for consideration in the development of the plant-specific TS for CPSES, Unit 1. On August 28, 1987, the Applicants responded to NRC proposing to submit for Staff review a mark-up of the current Westinghouse STS by October 30, 1987. The Staff made arrangements during this reporting period for a fire protection inspection at CPSES to be conducted the week of October 19, 1987, which was preceded by an inspection planning trip during the week of September 7, 1987.

During this reporting period the Staff also commenced an extensive review of the App 5l cants' design validation activities associated with the CAP. As part of this effort the Staff conducted an initial design inspection of the mechanical, civil / structural, electrical, and instrumentation and control design areas being reviewed by Stone and Webster Engineering Corporation (SWEC) in SWEC's Boston, Massachusetts, Cherry Hill, New Jersey, ?nd Comanche Peak site offices.

In addition, the Staff conducted audits in the CAP areas of large bore ,

piping and pipe supports, conduit supports, and heating, ventilation, and air . conditioning supports. Inspect!ons and audits of CAP activities will j continue throughout the next reporting period.

On August 18, 1987,. a member of the NRC Staff and a consultant s

visited the Cygna offices in Walnut Creek, California to discuss the general content of the Cygna Phase 4 report, the estimated schedule for I

its issuance, and the need for a public meeting prior to issuance of the .J report. Meetings were also conducted on August 25, 1987 in Cherry Hill, )

New Jersey to discuss FSAR changes on large bore piping design, and on August 26-28, 1987 in Boston, Massachusetts to discuss cable tray hanger l generic technical issues. The Staff is preparing audit or meeting )

summaries documenting these activities.

5. ONSITE INSPECTION ACTIVITIES l

Report 445/8704; 50-446/8704 documents the NRC inspection of the CPRT's : evbluation of the safety significance of the findings from CFRT inspections and documentation reviews.- The NRC onsite liispectors and consultants identified 4 generic concerns and 22 open items to which the

' Applicants were requested to respond.- The generic concerns were (a) determinations that dev]ations based on lack of required documentation were not safety significant, (b) improper or inadequate checking of calculations to evaluate the safety sign!ficance of a discrepancy, (c)'

failure to consider manuf&cturer's criteria and recommendations in 1

performing safety significance evaluations, and (d) apparent lack of consideration of the need to update or rectify certified stress / design reports. 'The violation identified in inspection Report 50-445/8706; i 50-446/8705 had minor. significance and involved reels of cable exposed to 1

sunlight.

On August 4, 1987 the Staff issued a Notice of Violation (NOV) to the Applicants for failure to make a timely report of a significant construction deficiency (inadequate mounting conditions for the 6.9kV switchgear in both CPSES, Units 1 and 2) pursuant to 10 CFR

50. 55(e) (EA-87-122 ) . This NOV addressed an issue previously identified as a potential violation in Inspection Report 50-445/8707; 50-446/8706. A second potential violation identified in inspection Report 50-445/8707; 50-446/8706 concerned a failure to establish adequate measures to require documentation of all nonconforming conditions. The Staff concluded that a

the second item was not a violation after reviewing additional information i presented by the Applicants during an enforcement conference on July 6, 1987. .

1987)', the Applicants have committed to screening all old open reports of l W

86-10 (copy and report correction previously provided by Board Notifications No. 86-24 dated December 11, 1986 and No. 87-06 dated ,

April 3, 1987, respectively) with attachments concerning Region IV inspection activities at Comanche Peak, (b) NUREG-1257 (March 1987),

Peak Steam Electric Station: Report of the Comanche Peak Report Review Groups," and (c) an April 14, 1987 memorandum from the EDO to the Commission on the implementation of the recommendations made by the Staff in NUREG-1257.

During this reporting period, the Office of Nuclear Material Safety and Safeguards issued Amendment No. 3 to the A(plicants' special nuclear )

l titles and revises specifics concerning the calibration frequency of portable radiation survey instruments.

During the week of July 13, 1987, the Regional Reactor Projects Branch administered reactor operator (RO) and senior reactor operator (SRO) licensing examinations for CPSES, Unit 1. Their report, issued on August 13, 1987, indicated that of the 12 candidates examined, 4 RO candidates and 7 SRO candidates successfully completed their examinations ,

and will be licensed. One SRO did not pass the examination. ,

During this reporting period the Staff completed record searches on 5 Freedom of Information Ac! requests related to CPSES received during July 1987, M and received 7 new requests for action.
