All work shall be performed in accordance with the delivery schedule specified in the attached Statement of Work and the contractor's proposal dated August 19, 1987, as revised on August 25, 1987, September ]

2, 1987 and negotiations held on September 22, 1987 and September l 24, 1987, which are all incorporated herein by this reference.

The parties agree to the following changes:

The total actual payment to be made for the accelerated effort will be determined by the combined total linear feet of partitions installed for all floors listed on the j accelerated schedule. j i

1. The contractor shall furnish all labor and materials required L to accelerate the delivery and installation of the demountable wall system at One White Flint North (OWFN). Installation shall

be completed in accordance with the following schedule

• Although floors 13, 15 and 16 are listed in the above l schedule, the increased rate for work performed under the )

accelerated effort shall not be paid for installation work on those floors. As agreed by the contractor on September 24, 1987, payment for the 15th and 16th floors of OWFN shall be made in accordance with the unit prices established in Section B of the contract. Payment for the 13th floor will be made at the rate negotiated on September 24, 1987.

2. The contractor will be given exclusive use of the loading dock and two elevators at OWFN on the week day scheduled for delivery of wall systems. The NRC will assure that.the corridor ,

from the loading dock to the elevators will, allow the contractor 1 unencumbered movement of materials. Upon receipt of notification-that deliveries of glass, wood doors or additional panels and accessories, may be necessary, the NRC Project Officer will provide the contractor with access to the loading dock, or alternative access to the building (i.e. the garage) , . and one el egator unlesu conflicts occur with the schedule activities of other  !

contractors or the building maintenance staff.

3. Access to the installation site at nights or on weekends  !

shall be scheduled with the Project Officer in advance of overtime performance.  ;

4. Installation of baseboard and ceiling trim shall be performed l after completion of work by electrical and communications

contractors.

5. All demountable wall offices must be completed in sufficient j time to allow overlapping Haworth Systems products to be j delivered and staged on each floor, two days preceding the scheduled completion of wall installations. All remaining l glazing, trim placement and final adjustments to walls, must be completed by the dates specified herein.  ;

6. Due to the anticipated occupancy status of OWFN, the delivery of materials for the 17th and 18th floors of the building may be required after normal business hours. The NRC Project Officer j shall provide the contractor with notification and instructions concerning such deliveries.

7. Inspection and acceptance of installation work shall be made in accordance with the terms and conditions of Section E of the contract.

EXCUSADLE DELAYS (APR 1984)

(a) Except for defaults of subcontractors at any tier, the Contractor shall not be in default because of any failure to perform this contract under its terms if the failure arises from causes beyond the control and without the fault or negligence of the Contractor. Examples of these causes are (1) acts of God or of the public enemy, (2) acts of the Government in either its sovereign or contractual capacity, (3) fires, (4) floods, (5) epidemics, (6) quarantine restrictions, (7) strikes, (B) freight

- embaigoes, and (9) unusually severe weather. In each instance, the f ailure to perf orm must be beyond the control and without the fault or negligence of the Contractor. " Default" includes failure ,

to make progress in the work so as to endanger performance.

(b) If the failure to perform is caused by the failure of a subcontractor at any tier to perform or make progress, and if the causes the failure was beyond the control of both the Contractor l and subcontractor, and without the fault or negligence of either, the Contractor shall not be deemed to be in default, unless (1) The subcontracted supplies or services were obtainable from other sources; h (2) The Contracting Officer ordered the Contractor in writing to purchase these supplies or services f rom the other ,

source; and 1 (3) The Contractor failed to comply reasonably with this l order.

(c) Upon request of the Contractor, the Contracting Officer shall ascertain the facts and extent of the failure. If the Contracting Officer determines that any failure to perform results form one or more of the causes above, the delivery ,

schedule shall be revised, subject to the rights of the l Government under the termination clause of this contract. j (End of Clause l 1 l
