Dear Congressman Vander Jagt:
We are pleased to respond to the letter dated July 19, 1987 from your f constituent, Ms. Marian Gyr, concerning liability of contractors for { government nuclear projects. Ms. Gyr's letter was transmitted to us by your j letter dated August 12, 1987. First, Ms. Gyr's concerns relate to liability l questions for the Department of Energy owned facilities which are operated j under contract with private industry. The Nuclear Regulatory Commission does I not license or maintain any regulatory authority over these types of l facilities. The pertinent provision of the expired act is Section 170.d of the Atomic Energy Act of 1954, as amended. In general, the Price-Anderson Act (the Act) provides funds for public liability t claims arising out of a nuclear accident. The Act expired on August 1, 1987 l and its extension is currently being considered by Congress. The House recently enacted a bill to modify and extend the Act. We have enclosed for your information a copy of a brochure entitled "The Price-Anderson System," which provides additional details of the Price. Anderson Act. i Sincerely, (Signed) T. A number of bills in both the House and Sen e contained provisions to make government contractors responsible for da ges to the public as a result of contractor negligence. The Department o Energy, among others, testified against these previsions. The bill re ntly passed by the House' extending and modifying Price Anderson does not proy1de for such contractor liability. A bill reported out by the Senate Con f ttee on Energy and Natural Resources does, however, provide for such co ractor liability.
