APPLICATION FOR SUBPOENA ON BEHALF OF THE SEACOAST ANTI-POLLUTION LEAGUE NOW COMES the Seacoast Anti-Pollution League and requests, pursuant to 10 CFR S2.720, that this Board issue a subpoena for the appearance of Colonel George Iverson, Commander of the New Hampshire State Police. l The relevance of Colonel Iverson's testimony is that New i

Hampshire State Police are relied upon for a number of specific l functions under the provisions of the NHRERP, including staffing of access control points and traffic control points and providing muncipal security.

SAPL has admitted contentions which bear on the availability of sufficient personnel to carry out the plans (SAPL Contentions lf SAPL earlier, on August 25, 1987, filed an application for subpoena of Mr. David Laughton, Secretary-Treasurer of Teamsters Local No. 633. On September 2, this Board denied that subpoena because it was for an " uncertain time", but said that it would afford SAPL an opportunity to refile at a date when the witnesses' appearance could reasonably be determined.

i 8 and 8A) . SAPL also has contentions which bear on the issue of I traffic control functions, some of which are to be performed by I'

the state police (SAPL Contentions 31 and 37). Additionally, SAPL has a contention which addresses the issue of whether the New England State Police Compact meets the regulatory requirement for letters of agreement which set out the concept of operations between federal, state and local agencies having an emergency j 1

response role and which also identify the emergency measures to be provided and the mutually acceptable criteria for their implement-ation.

SAPL wishes to question Colonol Iverson as to the availability of sufficient numbers of state police personnel to carry out the many responsibilities designated to them under the plan, particularly the traffic control functions. SAPL also wishes to inquire as to the capability of the State police to provide compensatory coverage of police functions in the non-participating communities. Further, SAPL wishes to question Colonel Iverson as to his view of the duties that the New England State Police Compact would hold the New Hampshire State police to perform in the event of a radiological emergency. Finally, SAPL would like to question Colonel Iverson as to his views on the feasibility of an adequate evacuation.

Service of the subpoena will be by Merrimack County Sheriff's Office. SAPL will pay the mileage fees paid to witnesses in the I

District Courts of the United States.
