/> C 8 EN 87-81 0FFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION USHRC-DS Licensee _: Detroit Edison Company (EA 87-133)

(Fermi 2 Plant) g yf 28 A 9 SL4 Docket No.

50-341

Subject:

PROPOSED IMPOSITION OF CIVIL PENALTY - $75,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Seventy-Five Thousand Dollars h

($75,000) will be issued on or about September 24, 1987 to Detroit Edison Company.

This action is based on the fact that on June 26, 1987 an uncont" 11ed heat-up of the reactor resulted in a change from Mode 4 (cold shutdown) to Mode 3 (hot shutdown) in violation of the facility Technical Specifications. The escalation and mitigation factors in the Enforcement Policy were considered and the c1vil penalty was increased by 100 percent because of past poor performance in the general area of concern.

However, unusually prompt and extensive corrective actions by the licensee including disciplinary actions against the individuals involved warranted a 50 percent reduction in the civil penalty.

In addition to the actions proposed against the utility, Letters of Reprimand will be sent to the four licensed operators involved in the event.

It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorized by the Deputy Executive Director for Regional Operations to sign this action.

The schedule of issuance and notification is:

fiailing of Notice September 24, 1987 Telephone Notification of Licensee September 24, 1987 The State of Michigan will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
