Dear Judge Smith:

Please find enclosed GPUN's Response to the NRC Staff Motion to Rescind Protective Order.

On Friday, September 18, Mr.

Richardson, (counsel for Bechtel who has assisted GPUN in the representation of this proceeding) spoke with Mr. Berry (counsel for the NRC Staff) concerning extending until today the date by which a response to the Staff's motion was due.

Mr. Berry indi-cated that the Staff would not object to the extension provided that the response would be telecopied and hand delivered to the NRC Staff.

On September 21, I telephoned your office, and, through your secretary, requested the extension.

Your secretary telephoned me the same day and informed me that you had granted the consent motion.

Sincerely,

/
