1. Was the information transmitted to, and received by, the NRC in con-fidence? Please give details.

Answer: No.

2. To the best of your knowledge, is the information currently available in public sources?

Answer: I don't know.

3. Does your company customarily treat this information, or this type of information, as confidential? Please explain why.

Answer: No. We have no proprietary interest in the information.

4. Would public disclosure of the information be likely to cause substan-tial harm to the competitive position of your company? If so, how?

Answer: No.

5. Is the information classified pursuant to an executive order or is it considered unclassified safeguards information as defined in 10 CFR 73.21?

Answer: Neither applies to us. Although we are not required by 10 CFR 73.21 to maintain confidentiality, our interest is in common sense protection of the information on DOE /NRC form 742 that reveals our holdings of highly enriched uranium.

USNRC July 2, 1987 Page 2 Our position is that information concerning the amount of highly enriched uranium in a licensee's possession should remain confidential even if it is less than a " formula quantity". Therefore, all parts of DOE /NRC form 742 showing significant quantities of E4 type SNM should be withheld from public disclosure under 10 CFR 9.5(a)(1).
