By letter dated June 15, 1987 [ Reference b)), you transmitted the subject 1983 proposed Notice of Vl91ation to Vermont Yankee requesting a written state-ment or explanation pursuant to the provisions of 10CFR2.201 within 30 cays.
The purpose of this letter is to request your consideration in extending the response time associated with this matter for the reasons stated below.
Vermont Yankee ccasiders all proposed Notices of Violation as highly serious matters and, accordingly, attaches the highest degree of importance in formally responding to them.
In this particular instance. you have requested that Vermont Yankee respond to concerns identified by an NRC inspection teans four years ago which we believa have previously been fully addressed and satis-factorily resolved.
Our preliminary review of the facts and extensive records assoclated With Vermont Yankne's fire protection compliance efforts nnd the 1983 inspection /
results support a conclusion which differs measurably from that contained in your June IF,, 1987 letter.
In particular, your letter acknowledges an " apparent lack of clarity which existed regarding the fire protection requirements," in the early 1980's.
This situation led to Vermont Yankee's implementation of a fire protection program and a subsequent request for an implementation audit prior to the deadline for c.ompliance with the Appendix R rule.
This was an attempt to ensure ourselves that our interpretations of the regulation were accurate and would withstand regulatory scrutiny. The result of this audit, as stated in the inspection report conclusions, indicated a concern with Vermont Yankee's interpretation and implementation of certain specific Appendix R rule f?

In response to the 1983 inspection report, Vermont Yankee diligently pursued resolution of the
' identified concerns on a schedule fully consistent with the implementation program prescribed by the Appendix R rule.
Your issuance of the June 15, 1987 letter indicates that the staff is not fully aware of Vermont Yankee's Appendix R compliance efforte. associated with and following the 1983 inspection.
In order for Vermont Yankee to fuliy and comprehensively respond to this matter in a formal written response, we respect-fully regtest that an additional 30 days be granted fo: our response to your recent letter. We feel that mutual benefit will be gained if your staff is
. fully aware of tf:e circumstances surrounding the audit and the extensive record cssociated with Vermont Yankee's actions taken in tne intervening four-year period to fully cosply with Appendix R.
Accordingly, we request your concurrence in extending the response time regarding this matter to August 14, 1987. Additionally, Vermont Yankee is pre-
