This is in response to your letter dited November 26, 1986 to Russel Rentschler, Office of' Nuclear Materisis Safety and Safeguards, concerning a nationality swap involving U.S. origin urenfum contained in low endched uranium and an equivalent quantity of Censdien origin natural urtnfum in the form of UF6 '
There is no legal requirement to obttin advance NRC spproval of the transaction described in your letter. If the N R C license of the companies involved . authorizes them to own, possess and use the urenfum being transferred , and they each executed a Form 741 es provided in NRC regulations covering the transaction described. they will satisfy HRC
! regulatory requiremen1 The Commission's jurisdiction in a case such as this is limited by the provisions of the Atomic Energy Act of 1954 and the Energy Reorganization Act of 1974, which confine NRC's domestic reguintory functions to protection of the public hetith and safety and the common defense and security, NRC's position should not be regarded as preempting the Department of Energy or the Depsrtment of State with respect to this tra nsaction.
