ANSWER TO NOTICE OF VIOLATION ~

Nuclear Regulatory Commission letter dated December 2, 1987 transmitted a security related Notice of Violation and Proposed Imposition of Civil Penalty which required a thirty day response. This violation involved an opening from a protected area into a vital area. Consumers Power Company admits that the self discovered situation loosely fits the severity level III criteria contained in 10CFR2 Appendix B, and that further protest will not be pursued.

However, we strongly feel that based upon licensee discovery and prompt actions taken further mitigation was warranted and a civil penalty should not-have been imposed. Our " Reply to Notice of Violation was submitted by letter dated January 4, 1988.

Pursuant to the notice a check in the amount of $25,000 is hereby remitted for the civil penalty.
