PROPOSED IMPOSITION OF CIVIL PENALTY - $200,000 '

This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Two Hundred Thousand Dollars

($200,000) will be issued on or about September 4, to Georgia Power Company.

This action is based on a number of violations involving the failure to (1) implement adequate compensatory neasures, (2) follow security procedural requirements, and (3) maintain positive access control over the facility.

The amount of the penalty was based on three Severity Level III problems, and the base value for violations in two of the problem areas was increased due to multiple examples of each. Additional violations were also cited, involving failure to maintain required physical barriers, although no civil penalty was assessed for these violations due to the licensee's identification and reporting of them, as well as the unusually prompt and extensive corrective action.

It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorized by the Deauty Executive Director for Regional Operations to sign this action. The scledule of issuance and notification is:

Mailing of Notice September 4, 1987 Telephone Notification of Licensee September 4, 1987 A news release has been prepared and will be issued after the licensee receives the Notice. The State of Georgia will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
