O NOTICE OF VIOLATION City of Grand Rapids License No. 21-15329-05 As a result of the inspection conducted on September 8,1987, and in accordance with 10 CFR Part 2, Appendix C - General Statement of Policy and Procedure for NRC Enforcement Actions (1985), the following violations were identified:

j 1.

Condition No. 12 of License No. 21-15329-05 requires that you test your sealed sources containing byproduct material for leakage and/or contamination at intervals not to exceed six months.

Contrary to this requirement, as of the day of the inspection, September 8,1987, you had not tested your sealed source containing cesium-137 and americium-241 for contamination or leakage since February 14, 1985, an interval of more than six months.

I This is a repeat violation.

This is a Severity Level IV violation (Supplement VI).

License Condition No. 16 requires that you transport licensed material in accordance with 10 CFR, Part 71.

10 CFR, Part 71.5 states that each licensee who transports licensed material shall comply with the applicable requirements in 49 CFR, Parts 170-189.

49 CFR 177.817 states that hazardous material may not be transported unless it is accompanied by a shipping paper.

Contrary to the above, a shipping paper did not accompany hazardous l

material transported to your temporary job sites in the State of Michigan.

I Specifically, cesium-137 and americium-241 in the form of sealed sources within moisture / density gauges were transported without shipping papers during various occasions between 1983 and the date of this inspection.

This is a repeat violation.

i This is a Severity Level IV violation (Supplement V).

License Condition No.11 requires that the training records of individuals designated as users of byproduct material be maintained.

Contrary to the above records of training for authorized users of byproduct material we,re not maintained.

This is a Severity Level V violation (Supplement VI).

License Condition No. 15 states that records of inventories to account i

for all gauges received and possessed under the license shall be maintained for two (2) years from the date of the inventory for inspection by the Commission.

Contrary to the above, no records of inventories have been maintained since 1983 to the date of this inspection.

I This is a Severity Level V violation (Supplement VI).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation:

(1) corrective action i

taken and the results achieved; (2) corrective action to be taken to avoid 1

further violations; and (3) the date when full compliance will be achieved.

Consideration may be given to extending your response time for good cause shown.
