Radiological Eme rgency Response Plan f or Commonwealth of Massachusetts; Request for Meeting
Dear Dr. Murley:
The purpose of my letter is to advise you of NHY's emergency planning activities since our meeting of May 7, 1987 and to request a meeting between our respective staffs.
First of all, in regards to the NHY oetition to reduce the EPZ, I would like to inform von that NHY has no olans at this time to recu hmi t such a recuest.
NHY will, however, continue to respond to past ques-tions of the Sta ? f as we had previously commi t ted (i.e., at meetings or in correspondence).
In regards to emergency planning f or that portion of the 10 mile EPZ within the Commonwealth of Massachusetts, NHY is in the process of finalizing a set of interim compensatory plans and procedures.
These plans and procedures'will supplement the detailed emergency response plan previously submi tted (Ref erence (b)].
It should be noted that it is our position that the plan previously submitted, in combination with the State of New Hampshire emergency response capabilities, demonstrates that an extensive bos 's and f ramework exists by which the health and i
safety of the public will be protected (Reference (c)].

United States Nuclear Regulatory Commission NYN-87077 Attention:
Dr. Thomas E. Murley Page 2 New Hampshire Yankee is continuing in its ef forts to obtain full or partial cooperation of the Commonwealth in the olanning process.
To date, however, we have been unsuccessf ul in persuading Massachusetts of the benefits of participation in emergency plenning.
Due to the continuing noncooperation by the Commonwealth, we f ully recognize that NHY will have to take certain compensatory measures in order to comply with your 10 mile EPZ requirements for full power li ce ns ure.
For many months, NHY has studied the emergency planning options available to us and as a result is finalizing a set cf interim compensating plans and procedures that supplement the Massachusetts plan.
This also provides f urther clarification as to how emergency planning can be implemented for the Massachusetts portion of the EPZ should the Common-wealth's ref usal to cooperate persist.
We also recognize that the NRC's emergency planning regulations are qualitative and general in nature.
This, unfortunately, can lead to dif fering interpretations of the same rule by different organiza-tions.
One recent example of this concerns us because of the poten-tially significant impact on the Seabrook licensing process.
On June 4, 1987, the Federal Eme rgency Management Agency (FEMA) issued its position on the contentions to be litigated during the upcoming hearings on the State of N11 Emergency Response Plans.
From our review, it appears that the FEMA positions on the evacuation / sheltering of the baach popula-tion is at odds with our interpretation of the intent of vour rules.
Bef ore we finalize the submittal, it is imperative tha*, we confirm our understanding and interpretation of the emergency planning requirements f or f ull powe r operation.
As such, I rec uee t that a meeting be <rbaduled between oar respective staff s, at the NRC's earliest convenience, to review tTe~ technical issues of concern to us.
This meeting would also serve as an opportunity f or NHY to present its schedule f or f uture submittals to 1
allow you to efficiently allocate your resources.
If the NRC should have any f urthe r questions regarding this matte r do not hesitate to contact Mr. William J. Daley, Jr. at (603) 474-9521,
