OPER^TiliG LICENSE The U. S. fluclear Regulatory Commission (the Commission) has issued Amendment No. 29 to Facility Operating License No. DPR-35, issued to Boston Edison Conpany (the licensee), which revised Technical Specifica-tions for operation of the Pilgrim Nuclear Power Station (the facility) located near Plynouth, flassachusetts. The amendment is effective as of its date of issuance, except that certain procedures will. not be effective until 90 days after its date of issuance.

The amendment incorporates fire protection Technical Specifica-tions on the existing fire protection equipment and adds administra-tive controls related to fire protection at the facility.

This action is being taken pendina completion of the Commission's overall fire protection review of the facility.

The application, as amended, for the amendment complies with the standards and requirements of the' Atomic Energy Act of 1954, as amended (the Act), and the Commission's rules and regulations. The Commission has made appropriate findf6gs as required by the Act and th'e Commission's rules and regulations in 10 Chapter I, which are set forth in the license amendment.

Prior public notice of this anendment was not required since the amendment does not involve a significant hazards consideration.

The Commission has issued the enclosed Exemption (Enclosure 1) to Section 50.48 of Appendix R to 10 CFR 50.

This action is in response to your letter dated March 18,1981 (BECO 81-59) which requested an exemption l

from the requirement to install a fixed suppression system in the Control

Room. Our letter of May 4,1981 stated that this request had a sound

~

technical basis which warranted further staff review.

The NRC evaluation, i

which forms the basis for this exemption, is contained in Enclosure 1.

This completes our response to your exemption requests of BECO 81-59, March 18,1981.

EXE!!PTION.

I.

The Boston Edison Company (licensee) is the holder of Facility Operating License No! DPR-35 which authorizes the operation of the Pilgrim Nuclear Power Station, Unit 1, at steady state reactor power levels not in excess of 1998 megawatts thermal (rated power). This license provides, among other thi6gs, that it is subject to all rules., regulations and orders of the Commission now or I

hereafter in effect. The facility consists of a boiling water reactor located at I

the licensee's site near Plymouth, Massachusetts.

II.

Section III.G.3 of Appendix R to 10 CFR Part 50 requires that a fixed fire suppression system be installed in an area, room or zone under consideration for alternative safe shutdown modifications.

In the case of Pilgrim I, under this provision a fire suppre'ssion system would be required in the Control A

Room..

The licensee indicated that the fire protection features currently installed together with constant availability of plant personnel assure that any fire would be detected and' controlled immediately (BECO 81-59, March 18,1981).

Uerefore, the licensee requested an exemption from the requirement to install

k' The licensee's exemption request was based on the following:

The plant can-be brought to a safe shutdown using the alternate shutdown system designed and installed for the Cable Spreading Room. The licensee has a detailed procedure to safely shut down i

the plant in the event the Control Room becomes uninh'abitable.

Smoke detection is provided in some panels.

A water hose station is installed in the corridor outside the main entrance to the Control Room.

The licensee has also confirmed that:

Portable fire extinguishers are provided in the Control Room.

The Control Room is separated from high hisk' areas by 3-hour fire rated barriers.

The modifications which the licensee's exemption request is based on a' e required r

n by Appendix R to 10 CFR Part 50. Therefore, the above modifications alone do f

not justify an exemption from the requirement to install a fixed fire suppression 1

system in areas where redundant divisions are located. However, the Control Room is a unique area of the plant that is required to be continually' occupied i

by the operators. In the event of a fire, manual fire suppression would be l

i effective and prompt. Because the operators provide a continuous fire watch _

in the' Control Room, a fixed suppression system is not necessary to achieva adequate fire protection in the Control Room..

i This is similar to the concept reflected'tn the staff's acceptance, on a short-term basis, of a continuous _ fire watch as an alternative to fixed

suppression systems when such systems become unavailable per 3.7.11.2 of the Standard Technical Specifications.

s Based on our evaluation, we conclude-that the licensee's ir{stralled fire protection for the Control Room meets the objectives of Section III.G " Fire Prat.tction of Safe Shutpwn Capability" of Appendix R to 10 CFR Part 50, and, a

therefore, the licensee'p rec,uest to be exempted from the requirement to provide a fixed fire suppressio$ dystem in the Control Room shhpd be granted.

III.

Accordingly, the Commission has determined that, pursuant to 10 CFR 50.12, an i

exemption is authorizea by law and will not endanger life or property or-the common defense and security and is otherwise in the public interest.

l The NRC staff has determined that the granting of this exemption will not result in any significant environmental impact and that pursuant to 10 CFR 51.5(d)(4) an environmental impact statement or negative declaration and environmental I

l; impact appraisal need not be prepared in connection with this action.
