Good afternoon Ms. Hunter,

Thank you for your May 13, 2020 letter. The purpose of the NRCs letter was to announce the NRCs intention to issue a Generic Environmental Impact Statement for Advanced Nuclear Reactors (ANR GEIS) and to invite Federally recognized Tribes to participate in an environmental scoping process in accordance with our Tribal Policy Statement.

The ANR GEIS is a generic environmental impact statement that summarizes the findings of environmental impacts of advanced nuclear power plant operations and construction associated with a new reactor license. The issuance of the ANR GEIS is a generic activity that does not identify specific sites for NRC licensing actions that would trigger the National Historic Preservation Act (NHPA) Section 106 or Section 7 of the Endangered Species Act (ESA) consultation requirements. Consultation required by the NHPA and ESA will be conducted and included in site-specific National Environmental Policy Act (NEPA) reviews for each new reactor application. The ANR GEIS does not authorize site-specific licenses or authorize any activities that would lead to the inadvertent discovery of human remains or other properties of cultural importance.

At the conclusion of the scoping period, the NRC will consider the scoping comments in development of the ANR GEIS and will issue a scoping summary report. Site-specific environmental reviews of advanced reactor applications will continue under the agencys current NEPA regulatory framework.
