APPROVAL OF NEXTERA ENERGY DUANE ARNOLD, LLC'S QUALITY ASSURANCE TOPICAL REPORT (FPL-3), REVISION 0
Dear Mr. Curtland:
By letter dated February 13, 2020 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20049A860), NextEra Energy Duane Arnold, LLC (NEDA), formerly FPL Energy Duane Arnold, LLC requested approval of changes to its Quality Assurance Topical Report (QATR) FPL-3 in accordance with paragraph 50.54(a)(4) of Title 10 of the Code of Federal Regulations (10 CFR). The U.S. Nuclear Regulatory Commission (NRC) requested additional information by email dated May 28, 2020 (ADAMS Accession No. ML20153A377).
NEDA submitted its response by letter and enclosure dated July 26, 2020 (ADAMS Accession No. ML20178A519). Subsequently, the Office of Nuclear Reactor Regulation, Division of Reactor Oversight, Quality Assurance and Vendor Inspection Branch staff reviewed NEDAs submittal and determined that the quality assurance program described in the QATR FPL-3 meets the criteria of Appendix B to 10 CFR Part 50, and was, therefore, acceptable (ADAMS Accession No. ML20209A533).
In a letter dated December 29, 2006 (ADAMS Accession No. ML063540197), the NRC approved common QATR FPL-1, which included other nuclear stations in addition to NEDA. In a letter dated January 18, 2019 (ADAMS Accession No. ML19023A196), NEDA provided formal notification of the intention to permanently cease power operations at Duane Arnold Energy Center (DAEC) in the fourth quarter of 2020. To support the transition of DAEC to a decommissioning facility, NEDA has developed a site-specific DAEC QATR FPL-3 using the QATR FPL-1 as the basis. QATR FPL-1 will no longer be effective at DAEC following approval and implementation of QATR FPL-3. In addition, NEDA also requested NRC review and approval to apply the program to 10 CFR Parts 71 and 72 activities in accordance with 10 CFR 71.101(f) and 10 CFR 72.140(d), respectively.
Enclosed is the Quality Assurance (QA) Program Approval for Radioactive Material Packages No. 0965, Revision No. 0. This approval satisfies the requirements of 10 CFR 71.17(b) and 71.101(c) for a QA Program approved by the NRC, as well as, approval of those changes to your quality assurance program that are considered reductions in commitments to the NRC prior to implementation as required by 10 CFR 71.106. Under separate cover, DAEC is also being removed from the NextEra Energy QA Program Approval for Radioactive Material Packages No.
0169.
D. Curtland Termination of your materials license does not cause this approval to be automatically terminated. If you wish to amend this approval and have determined it reduces commitment, or would like to terminate this approval, please request it in writing.
This letter also serves as a reminder that if you are using or planning to use an NRC-approved packaging, you must be registered for use of that packaging with NRC. Registration for use of NRC-approved packagings should be made pursuant to 10 CFR 71.17(c)(3).
In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter and its enclosure will be made available electronically for public inspection in the NRC Public Document Room or from the NRCs ADAMS, accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
