OF JULY 9, 2020, TELECONFERENCE WITH NUCLEAR ENERGY INSTITUTE AND INDUSTRY REGARDING TASK INTERFACE AGREEMENT PROGRAM OVERHAUL-AVAILABILITY OF DRAFT COM-106 GUIDANCE FOR COMMENT (EPID L-2019-PMP-0002)

On July 9, 2020, a Category 2 public teleconference was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Nuclear Energy Institute (NEI) and industry (collectively, industry). The purpose of the teleconference was to inform industry and members of the public about the availability of the draft updated Nuclear Reactor Regulation (NRR) guidance COM-106 for comments and discuss the timeline and process of the comment solicitation. The meeting notice and agenda, dated June 29, 2020, are available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML20190A134. A list of attendees is enclosed. No regulatory decisions were made during the meeting.

Discussion The NRC staff presented an update on the progress of the ongoing Task Interface Agreement (TIA) Program Revitalization project, to be rebranded as Technical Assistance Request (TAR).

The staffs presentation slides can be found at ADAMS Accession Nos. ML20190A117. The NRC staffs document for comment (ADAMS Accession No. ML20178A474) was attached to the meeting notice and consisted of an updated draft for the TAR process, COM-106, Revision 6, with draft Safety Significance Determination (SSD) Guidance and SSD Tool. Discussion highlights are as follows.

  • The NRC staff noted that, as indicated in the meeting summary for the November 7, 2019, public meeting dated December 5, 2019 (ADAMS Accession No. ML19329B485),

while internal procedures are not typically published for comment, an exception was being made here, where staff acknowledged that the overhaul of the TIA process was intricate, and unique in regard to its need for efficient coordination with external stakeholders at designated points. An interim draft version of the COM-106 was made

publicly available for general awareness in December 2019, per the industrys request, However, no comments were solicited by NRC staff.

  • The NRC staff indicated that the draft COM-16 has completed internal stakeholder review. The attached draft, a near complete product, was being made available for comments to the industry, and the public may also provide comments.
  • Leveraging previous public engagements, to take the project forward, the NRC staff expressed the plan to facilitate a public discussion in approximately 2 weeks from the teleconference, to be focused on portions of the draft that directly involve interactions with external stakeholders.
  • The NRC staff requested that industry and members of the public review the draft COM-106 and bring their comments for discussions at the next public meeting, which will be held in approximately 2 weeks and noticed separately. The NRC staff also indicated that no formal written or electronic comments were being requested or will be accepted.

The next public engagement will be the only forum to receive and discuss comments.

Further, the NRC staff concluded that industry and public comments will be appropriately considered in the final version of the TAR process (COM-106) guidance.

  • Members of the industry did not have any clarifying questions.

There was one member of the public in attendance, Catherine Skopic, representing the Sierra Club of New York City. Ms. Skopic asked the NRC staff if the public comment period would be extended and if she could submit comments by e-mail. The NRC staff noted that members of the public are welcome to provide comments, and the NRC staff does not anticipate extending the comment period at this time, due to prior public engagements on the process upgrade. The NRC staff also indicated that comments will not be accepted in written or electronic form, and that all industry or public comments will be collected and discussed at the next public meeting, that will be noticed separately.
