Overlook Hospital (EA 97-246)

PROPOSED IMPOSITION OF CIVIL PENALTY - $2,750 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $2.750 will be issued on or about August 21. 1997 to Overlook Hospital. Summit. New Jersey.

This action is based on a Severity Level III problem involving:

(1) failure to prepare a written directive prior to administering iodine 131 as sodium iodide to a patient: and (2) failure to instruct an individual in the licensee's medical quality management program. These violations contributed to a misadministration in which seven millicuries of iodine-131 was administered instead of the intended 2 milliturie dose.

Because the licensee has been the subject of 3revious escalated enforcement action within the previous two inspections, t1e staff considered whether credit was warranted for Identification and Corrective Action.

Credit was not warranted for identification because the licensee did not identify the violations that led to the misadministration.

Credit was warranted for the licensee's numerous corrective actions. This assessment resulted in the

' proposed civil penalty amount of $2.750.

l It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Mailing of Notice August 21. 1997 Telephone Notification of Licensee August 21, 1997 The State of New Jersey will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
