December 31,1999 into a Confirmatory Order Modifying License. GPU Nuclear understands that the confirmatory order will be substantially the same as the order issued to WPPSS on i

March 25,1998.

GPU Nuclear has agreed to waive its hearing rights based on this understanding, but is not waiving any right to a hearing with respect to any terms or conditions that are not disclosed in NRC's letter to GPU Nuclear dated April 27,1998, or with respect to any future request for an extension based on a showing of good cause.

1 Accordingly, GPU Nuclear is transmitting the enclosed signed agreement as proposed in the above referenced NRC letter. This schedule commitment is consistent with the original Thermo-Lag resolution commitment made in GPU Nuclear letter to the NRC dated July 7,1995 and included in the latest revision of the TMI-l Integrated Living Schedule. The proposed consent agreement identifies several GPU Nuclear letters which contained descriptions of the planned corrective actions at the time of submittal. Some of these early planned actions may have been revised or superceded as described in the later referenced submittals.

I, James W. Langenbach, Vice President and Director, GPU Nuclear Corporation, Three Mile Island Nuclear Station, Unit No.1, hereby agree on behalf of GPU Nuclear Corporation et al.,

that GPU Nuclear Corporation et al. will comply with the following commitment:

GPU Nuclear Corporation et al. shall complete final implementation of Thermo-Lag 330-1 fire barrier corrective actions at Three Mile Island Nuclear Station, Unit No.1, described in the GPU Nuclear Corporation submittals to the NRC dated February 10, 1994, December 5,1994, July 7,1995, August 16, 1996, November 5,1996, December 31, 1996, August 19, 1997, and November 23, 1997, by December 31, 1999, excluding those corrective actions which are the subject of the pending exemption request dated December 31,1996, and supplemented by letters dated July 31,1997, September 8,1997 and December 30,1997. A schedule for completion of any activity associated with the items excluded will be determined separately.

GPU Nuclear Corporation also agrees to incorporating this commitment into a Confirmatory Order Modifying License (Order) that will be effective immediately upon issuance. I recognize that by signing below, GPU Nuclear Corporation et al. consents to the issuance of an immediately effective Order incorporating the above commitment and, by doing so, pursuant to 10 CFR 2.202(a)(3), GPU Nuclear Corporation et al. will not have a right to request a hearing on all or any part of this Order.
