Box 1295 Birmingham, AL 35201-1295 SUBJECT: NRC INSPECTION REPORT NOS. 50-424/97-03 AND 50-425/97-03 Dear Mr. McCoy; We have completed our review of your response of July 25,1997, to our Notice of Violation issued on June 25,1997, concerning activities conducted at the Vogtia facility. We have evaluated your response to Violation A and fnund that it meets the requirements of , ! 10 CFR 2.201. We will examine the results of your corrective action during a future inspection. In your response to Violation B, you state that Southem Nuclear denies that a violation of regulatory requirements occurred. The basis for your denial as we understand it is that Southern Nuclear considered the union representative to be the representative of the employee. After receiving your response, NRC contacted the employee and asked if at any time he expected or asked the union representative to act as his personal representative with respect to obtaining drug test results. The employee replied emphatically in the negative. NRC asked the employee if any consent forms were signed by him to allow the union rapresentative to ac; as his representative with respect to obtaining access to drug test results. Again the employee replied in the negative. Therefore NRC doc 3 not agree that Southom Nuclear was authorized to release the personalinformation to the union representativo under an exemption to 10 CFR 26.29(b). You also contend that disclosing personal information to the " Southern Nuclear labor relations staff" was an acceptable practice under an exception to 10 CFR 26.29(b) because 5 they have a need to have access to the information in performing assigned duties. NRC ' does not agree. The rule is purposely specific on limiting the licensee in the disclosure of the = personalinformation collected and maintained. With these two violations, and a recent similar violation issued to Southem Nuclear regarding an incident at Plant Hatch, NRC is concemed that Southem Nuclear is not providing sufficient attention to protecting the personal information collected within sjour company under the provisions of 10 CFR Part 26.
