SUBJECT: NRC INSPECTION REPORT NO. 50-454/98009(DRP); 50-455/98009(DRP)

AND NOTICE OF VIOLATION

Dear Mr. Kingsley:

On April 6,1998, the NRC completed an inspection at the Byron 1 and 2 reactor facilities. The

enclosed report presents the results of that inspection.

During this inspection period, we found that routine operations of the facility were conducted in a

safe and controlled manner. This was most evident during the restart and subsequent testing of

the new Unit i steam generators. We also noted that operations were generally conducted in

accordance with Nuclear Opurations Division Operations Department Standards.~

We are concemed about three violations of NRC requirements that were identified during this

inspection period. The first violation pertains to an operational mode change prohibited by

Technical Specifications. We are concemed because this violation should have been prevented

by your corrective actions resulting from a previous event which is documented in NRC

Inspection Report No. 50-454/97005(DRP); 50-455/97005(DRP). The second violation involves

two examples of a failure to provide procedures appropriate to the circumstances for control

room ventilation system operation and for the control of work requests. The third violation relates

to the failure to follow radiation protection procedures goveming the posting of contaminated i

areas. The second and third violations are being cited because they were identified by the NRC.

These violations are cited in the enclosed Notice of Violation (Notice), and the circumstances

surrounding the violations are described in detail in the enclosed report. Please note that you are

required to respond to this letter and should follow the instructions specified in the enclosed

Notice when preparing your response. The NRC will use your response, in part, to determine

whether further enforcement action is necessary to ensure compliance with regulatory

requirements.
