By letters dated April 16,1993, February it 1994, December 8,1994, March 22,1995, June 13, 1995, November 8,1995, February 20,1996, June 26,1996, and November 5,1996, you l  : responded to Generic Letter (GL) 92-08, "Thermo-Lag 330-1 Fire Barriers," dated December 17, i

1992, and followup requests for additional information.

At the meeting between Toledo Edison Company (one of the three licensees for Davis-Besse) representatives and NRC staff on April 3,1997, your representatives presented documents which stated the schedule for resolution of Thermo Lag 330-1 issues at Davis-Besse. These l documents were attached to the NRC meeting summary dated April 16,1997.

Due to NRC staff concems that Thermo-Lag corrective actions have not been completed at

Davis-Besse to date, and to preclude any schedule slippage, we plan to modify the license by l order to make this commitment a requirement, if you consent, we plan to incorporate the commitment into a Confirmatory Order Modifying License (Order) as follows:

The Toledo Edison Company, Centerior Service Company, and the Cleveland Electric illuminating Company (the licensees) shall complete final implementation of Thermo-Lag 330-1 fire barrier corrective actions at the Davis-Besse Nuclear Power Station, Unit No.1, by December 31,1998, as described in the licensees' ,

submittals to the NRC dated April 16,1993, February 11,1994, December 8,

! 1994, March 22,1095, June 13,1995, November 8,1995, February 20,1996, June 26,1996, and November 5,1996, and as presented at the licensees' l meeting with the NRC staff on April 3,1997, as documented in the NRC meeting l' summary dated April 16,1997, i

By consenting to issuance of the Order confirming the above commitment, the licensees are

waiving their right to request a hearing on all or any part of the Order. You must regn, as noted on the enclosure to this letter, that you agree to such a commitment on behalf of the licensees and return the enclosure within 10 business days of the date of this letter to Mr. Samuel J.

Collins, Director, Office of Nuclear Reactor Regulation, U.S. Nuclear Regulatory Commission, One White Flint North,11555 Rockville Pike, Rockville, MD 20852-2738. After receiving your written consent, the NRC will issue the aforementioned Order.
