Mueller Site Vice President Zion Station Commonwealth Edison Company - 101 Shiloh Boulevard Zion, IL 60099 - SUBJECT: NRC INSPECTION REPORT NO. 50 295/97013(DRP); 50-304/97013(DRP); AND NOTICE OF VIOLATION Dear Mr. Mueller: This refers to the inspection conducted on April 4 through May 29,1997, at the Zion facility. The onclosed report presents the results of that inspection During this eight-week inspection period, your staff's performance was characterized by continued focus on improving operator performance in the areas of procedural compliance and adherence to standards, as demonstrated in the Phoenix training program. However, inconsistont procedural complianco appears to be a problem that extends beyond the operations department as reflected in the occurrence of a fire in the Unit 1 containment, the delayed reporting of the fire to the control room, and inadequate storage of equipment with respect to solsmic concerns. Based on the results of this inspection, the NRC has determined that violations of NRC requirements occurred. Theso violations are cited in the enclosed Notice of Violation (Notico) and the circumstances surrounding them are described in detailin the subject inspection report. The first violation involves licensed operators routinely exceeding overtime limitations to accomplish operations department work activities. Deficiencies in i the control of overtime are a long-term concern which the licensee has not yet adequately resolved. The second violation involves three examples in which personnel did not perform activities as required by procedures, with two of the examples related to the Unit 1 containment fire. With respect to the violation involving deliberate falsification of records, the NRC has concluded that information regarding the reason for the violation and the corrective actions taken to correct the violation and prevent recurrence are already adequately addressed on the docket in your April 3,1996, response to the Severity Level lil Notice of Violation and Civil Penalty dated March 22,1996, and in the enclosed report. Therefore, you are not required to respond to this violation unless the discussion in these documents does not accurately reflect your corrective actions or your position, in that case, or if you choose to provide additional information, you should follow the instructions specified in the enclosed Notice. You are required to respond to this letter with respect to the remaining violations and should follow the instructions specified in the enclosed Notice when preparing your response. The NRC will use your response, in part, to determine whether further enforcement action is necessary to ensure compliance with regulatory requirements. In accordance with 10 CFR 2.790 of the N9C's " Rules of Practice," a copy of this letter, its enclosure, and your response will be placed in the NRC Public Document Room.
