Dear Mr. Quillin:
As requested in your February 10,1998 letter, we have reviewed the proposed regulation, Part 17 of Colorado Rules and Regulations Pertaining to Radiation Control, Transportation of Radioactive Materials. We recognize that your current plans are to have these regulations become effective in the near future. The regulations were reviewed by comparison to the equivalent NRC regu!ations in 10 CFR Part 71. We also discussed our review of the regulations witn Ken Weaver and Christi Parsons on April 21-22,1998.
As a result of the NRC review, we have no comments. Please note that we have limited our review to regulations required for compatibility and/or health and safety. Under our current procedure, a finding that a State regulation meets the compatibility and health and safety

categories of the equivalent NRC regulation may only be made based on a review of the final State regulation. However, we have determined that if your proposed regulatior,s were adopted without significant change, they would meet the compatibility and health and safety categories established in OSP Intemal Procedure B. 7.
We request that when the proposed regulations are adopted and published as final regulations, a copy of the "as published" regulations be provided to us for review. As requested in our All j
Agreement States Letter SP-96-027, " Request to Highlight Changes to Agreement State Regulations Submitted to NRC for Compatibility Review" (March 16,1996), please highlight the final changes and send one copy in a computer readable format, if possible.

We have reviewed the final Colorado regulation Part 17 of olorado Rules and Regulations Pertaining to Radiation Control Transportation of Radica ive Materials, which will became effective in the near future. The regulations were review d by comparison to the equivalent NRC regulations in 10 CFR Part 71. We also discussed ur review of the regulation ath Ken Weaver and Christi Parsons on April 21-22,1998.
As a result of the NRC review, we have determined tha the Colorado final regulations, as proposed, meet the compatibility and health and safet categories established in OSP Internal Procedures B.7 if adopted without change.
