Dear Mr. Felgenbaum:
Enclosed is a copy of our January 30,1997, response to your December 19,1996, letter regarding the Haddam Neck Plant that permanently ceased operations.
We stated that invoice AR000197000197dated October 5,1996, in the amount of $686,500 for the first quarter FY 1997 annual fee, (which was paid by Connecticut Yankee) will in tillikelihood have to be adjusted once the final annual fees for FY 1997 are established.
Based on the FY 1997 final fee rule which was published May 29,1997, and became effective July 28,1997, an adjustment is needed. As stated in the final rule, the power reactor annual fee for FY 1997 Is $2,978,000. Since License No. DPR-61 was in effect for 71 days in FY 1997 (October 1,1996, through December 10,1996), the prorated fee for the Haddam Neck Plant is $579,289 (71 days @ $8,159/ day).
The $107,211 overpayment is refundable. In order to process the refund, we need your Automated Clearing House (ACH) Information and Tax identification Number (TIN). Enclosed is information regarding this requirement and the Enrollment Form (SF 3801). The refund will be processed upon receipt of completed Form SF 3881, if you have any questions regarding the fee requirements, please contact Mamella Rodriguez at 301-415-6078.
