l NRC STAFF'S MOTION FOR ADJUSTMENT OF FILING SCHEDULE ESTABLISHFD IN LBP-98-7 i

l Pursuant to 10 C.F.R. f 2.730, the NRC Staff (" Staff") hereby requests that the schedule l

l established in the Licensing Board's Memorandum and Order of April 22,1998 (" Order"),

LBP-98-7,8 be adjusted in the following manner in order to afford the Staff and other parties an

! additional limited period of time in which to prepare and file motions for reconsideration and l

status reports pursuant to that Order.

1. The Staff requests that the date for filing motions for reconsideration (LBP-98-7, slip op. at 169) by all parties be extended by two days, so that any such motions would be filed l on or before May 6,1998. In addition, the Staff requests that the status reports required pursuant to the Licensing Board's Order (Id. at 162-63), which will require certain discussions among the parties prior to filing, be allowed to be filed on or before May 15,1998, or at such i

other time as the Board determines would not unduly interfere with tre parties' need to file responses to any motions for reconsideration that may be filed.

2. The Staff submits that an extension of time of two days for the filing of motions for reconsideration is necessary to enable the parties to prepare such motions as they determine to be appropriate, and would not unduly interfere with the scheduled prehearing conference to be held on May 19, 1998.
3. Counsel for the Staff has , discussed this request with Counsel for the Applicant, the State _ of Utah, the Skull Valley Band of Goshute Indians, Ohngo Gaudadeh Devia, and Castle Rock Land and Livestock, L.C., et al., and is authorized to state that those parties do not oppose this request. The Staff has attempted without success to contact Counsel for the Confederated Tribes of the Goshute Reservation, and is unable to state that party's position with j i

respect to this request. '
