September 30,1997 EN 97-092 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee:
Commonwealth Edison Company (EA 97 265)
Braidwood Station Docket Nos. 50-456 and 50-457 Sublect: PROPOSED IMPOSITION OF CIVIL PENAliY - $55,000 This is to inform the Commission that a Notice of Violation and Proposed imposition of Civil Penalty in the amount of $55,000 will be issued on or about October 3,1997 to the Commonwealth Edison Company. This action is based on a Severity Level lli violation involving the failure to comply with technical specifications. Specifically, the centrifugal charging system pump casings and discharge piping high points were not vented at least once every 31 days as required by technical specifications.
Because this was not the first escalated aforcement action within the past 2 years, the staff considered whether credit was warrante:' ';or identification and corrective action. Credit was
- not warranted for identification because the violation was identified by the NRC. Credit was warranted for corrective action because the corrective actions were considered prompt and comprehensive.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule ofissuance and notification is:
l Malling of Notice October 3,1997 Telephone Notification of Licensee October 3,1997 The State of Illinois will be notified.
The licensee has thirty days from the date of the Notice in which to respond. Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
