I have receis ed the staffs response dated July 24,1997, to Commissioner Dieus' questions regarding SECY-97-134. Please see my " Negative Consent" comments as follows:
I have no objection to the staff s recommendation ofimplementing Altemative 3 at the present time. In resolving this issue of commercial use of codes by foreign organizations, the staff should look beyond the thermal-hydraulic codes to include other codes that may or will be faced with the same issue.
A wider intemational distribution and application of the thermal-hydraulic codes and other codes could enhance world-wide nuclear safety. Therefore, for the longer term, the staff should explore with the Executive Branch the pros and cons of further lifting of the restrictions on commercial use of the codes by foreign organizations (Altemative 1). Any future options presented to the Commission should ensure that there are consistent policies among the govemment agencies. This should be done taking into consideration the intellectual property rights protection and in consultation with the Office of the International Trade Representative.
