Dear Mr. Chairman:

i The Omnibus Budget Reconciliation Act of 1990, as amended, requires the Nuclear Regulatory l

Commission (NRC) in each of the fiscal years 1991 through 1999 to collect fees and annual charges that approximate 100 percent of its budget authority, less the amount appropriated to the NRC from the Nuclear Waste Fund. Consistent with past practice, we are providing you the status of fee collection activities for FY 1999. Public Law 105-245 appropriated $469,800,000 to 1

the NRC for fiscal year 1999 of which $17,000,000 was derived from the Nuclear Waste Fund and is excluded from license fee revenues and $3,200,000 was appropriated for regulatory I

reviews and other assistance provided to the Department of Energy and other Federal agencies

- which also is excluded from license fee revenues. Public Law 106-51 subsequently enacted a rescission reducing our appropriation by $976,000.

i Of the remaining $448,624,000,99 percent was collected through fees and other charges.

I Sincerely, i
