Modification No. 2. Task Order No. 303 entitled. " Generic Graphical User interface for Analytical Codes' under Contract No.
NRC 03 95 026 lhe purpose of this modification is to document the terms and conditions.
increase the task order ceiling and obligate funds relevant to the final settlement of Scientech's claim related to cost growth incurred under Task Order No. 303 of Contract No. NRC-03 95 026.
Accordingly:
WHERLAS lask Order No. 303 was entered into between the NRC and Scientech on July 2.1996, with a total cost ceiling of $170.154.00.
WHEREAS, the task order required Scientech to build a grapF user interface application interf ace that can be used to build specific.nerfaces for the individual analytical codes.
WHEREAS, verbal authorization in the amount of $26.000 was provided to Scientech on March 25. 1997, to initiate additional work provided for under NRC RFP dated February 4. 1997.
WHEREAS. Scientech was instructed to stop work on April 8 1997, when NRC learned that a cost growth had occurred under the basic tosk order.
WHEREAS. Scientech requested a monetary adjustment for its cost growth incurred under task order 303 in letter dated June 6. 1997.
WHEREAS. the parties, agreeing to settle all claims and disputes under the task order related to the cost growth, agree as follows:

The task order ceiling amount is increased by $67.300.00 f rom
$170.154.00 to $237.454.00 (including $26.000 verbal

authorization), of which the amount of 1229.701.00 represents the y
reimbursable costs, and the amount of 51.753.00 represents the fixed fee.

The pertod of performance for work perfonned under this task order is July 2,1996 through April 8.1997.

All deliverables required under the task order have been received and accepted by NRC.

Scientech, for itself, its successors cnd assignees. hereby releases and forever discharges the Government, its officers, agents and employees from any and all further claims however derived, and agrees to refrain from lodging lawsuits in any forum, for additional adjustments or compensation arising under. or related to, the cost growth incurred under task order 303.
The parties agree that the changes and compensation provided by this nodification constitute the complete and final settlement for compensation of all costs associated with the cost growth.
Scientech expressly represents and acknowledges that in agreeing to the terms and adjustment contained herein, it has considered and made allowances for every cost, regardless of when incurred. for its claims related to the cost-growth, including interest and attorneys fees, but excluding any indirect rate adjustments that may be allowed in accordance with FAR Clause 52.232-20.
