i The Office of State Programs has reviewed the subject action with respect to the current NRC " Policy Statement on Adequacy and Compatibility of Agreement State Programs."
I We offer for your consideration the following statement to replace the one in the section on Aareement State Considerations:
"The NRC has determined that this rule addresses a regulatory area which is reserved to the NRC. This is an NRC program element that cannot be relinquished to Agreement States pursuant to the Atomic Energy Act."
We concur on this action, subject to addition of the foregoing statement.
