Dear Mr. Godwin:
As you stated in your May 28,1999 letter, the Nuclear Regulatory Commission (NRC) informed you that there are five sites in Arizona that do not have clear documentation on site decommissioning. The December 16,1997 letter that you referenced stated that NRC was prepared to send you the existing documentation for these sites for your use in making a decision on the radiological status of the sites. You informed the NRC that you did not want the files and that if you acted on these sites that you might expose the State to potentialliability.
i The Commission directed the NRC staff to discontinue work on sites located in the Agreement States since any materialidentified falls under the Agreement State's jurisdiction. Therefore, the NRC staff has not taken any additional action on these five sites. During a discussion, i
subsequent to the receipt of your letter, I indicated that the Commission, in the Staff Requirements Memorandum for SECY-98-273, asked the staff to conduct further work to resolve NRC/ Agreement State jurisdiction issues and evaluate possible approaches for retuming identified sites to NRC jurisdiction., You suggested some approaches for consideration, including joint NRC/ Agreement State determinations regarding these sites and whether any additional action was necessary. We willinclude this suggestion and others in our
