We have reviewed your letter of July 10, 1987, in which you offered an explanation of Addendum 01 to the RFP for f.iverton Remedial Action Wark.
Addendum 01 would provide that "Each payrant application should be accompanied by a signed certificate of Occeptance by NRC stating that the materials in question were disposed of pursuant to NRC license amendment, approved reclamation plan, and in accordance with NRC Regulation 10 CFR 40 requi rements. "
The NRC will ensure compliance with regulatory and license requirements thrcugh our regular licensing, inspection, and enforcement programs. We deem it inappropriate for NF.C to be involved in the contractual relationship between your Remedial Action Contractor and the sub' contractor chosen to dispose of Riverton wastes.
Please delete this provision from your contract documents.

This is a Wyoming State DEQ requirement.
This requirement should not ie required for wells to be buried below the finish grade.
the provision should not apply to buried sealed wells (see attached telecon MKE Doc. NoWi'lliam RVT-T-01-01107-00).

Revise Paragraph 02090-3.1.A.5.f to read:
The top of the plug of each abandoned well which is sealed with the top of the plug at or above finished grade, shall be clearly and permanently marked by ingriptioh; either in the cement or on a steel plate embedded in the cement, with the perniit nuniber, well identification number and date nf plugging.
