l CITIZENS AWARENESS NETWORK. INC. REPLY TO NUCLEAR REGULATORY COMMISSION STAFF'S ANSWER TO AMENDED PETITION TO INTERVENE Citizens Awareness Network, Inc. (CAN), hereby replies to Nuclear Regulatory Commission Staffs (NRC StalTs) answer to CAN's amended petition to intervene in the license amendment proceeding on YAEC's proposed License Termination Plan (LTP).

1. Response to NRC StafTs Answer.

l CAN hereby responds to the NRC Staffs Response (April 14,1998) to the Franklin Regional Planning Board's (FRPB) request fcr a hearing. CAN wishes to express shock and consternation at the NRC stafTs questioning and derision of this legally constituted government body. The Franklin County Commissioners repeatedly hosted and facilitated NRC meetings with the public on the decommissioning of Rowe.

The Commissioners have participated in the process since the Fall of 1993. NRC never objected to the Commission's participation in the past. In fact, NRC staff repeatedly i 98o4290204 980427 PDR- ADOCK 05000029 G PDR 9h

i solicited the Commissions participation in the Rowe decommissioning plan approval l

process. CAN is concerned that there may be conflict ofinterest issues that exist in this situation. A YAEC paid employee, Stanley Gall, is a member of the Franklin County Council of Government and the conflict ofinterest expressed in the letter sent by Mr.

Brad C. Councilman to the NRC Commissioners by different sectians of the Franklin Council County of Govemment may represent this conflict. Mr. Councilman was )

chosen by NRC and YAEC to facilitate the License Termination Plan Meeting held in Buckland, MA on January 13,1998. Mr. Councilman appeared to take a partisan position at the meeting by arbitrarily cutting off audience questioning of the NRC and the l

licensee. There were members of the public who left the meeting in frustration when Mr.

. Councilman cut ofTquestioning and public participation. Members of the public volunteered to give up their time to speak to allow for further questions from the audience. Mr. Councilman refused to allow this and ended the meeting early. Therefore, CAN believes that Mr. Councilman's letter to the NRC Commissioners should not I influence the Panel's decision on standing for the FRPB. j Respectfully Submitted,
