Dear Mr. Block:
I am responding to a Petition pursuant to 10 CFR 2.206 submitted by you on December 6.1996, on behalf of Citizens Awareness Network. Inc. (CAN or Petitioner).
The Petition was submitted to the Secretary of the U.S. Nuclear Regulatory Commission (NRC) and requested evaluation of two enclosed documents relating to the Vermont Yankee Nuclear Power Station (Vermont Yankee facility) operated by the Vermont Yankee Nuclear Power Corporation (Licensee).
The first document enclosed with the Petition is a CAN Memorandum, dated December 5. 1996, that reviews information presented by the Licensee at an enforcement conference held on July 23, 1996, involving the minimum flow valves in Vermont Yankee facility's residual heat removal (RHR) system, CAN raises a concern that the corrective action taken by the Licensee in opening these valves to provide RHR pump protection may have introduced an unreviewed safety question with regard to containment isolation. The second document enclosed with the Petition is a CAN Memorandum dated December 6. 1996, that contains a review of certain licensee event reports (LERs) submitted by the Licensee in the latter part of 1996.
Various issues are presented such as fire protection, tornado protection. thermal equipment operability, and equipment testing. protection for piping lines, In the Petition, the Petitioner requests that "the Commission and EDO evaluate these documents, pursuant to 10 CFR 2.206, to see if enforcement action is warranted based upon the information contained therein." By letter dated February 12. 1997, the NRC acknowledged receipt of the December 6,1996.
Petition.
The Petition was referred to the Office of Nuclear Reactor Regulation in accordance with 10 CFR 2.206 for preparation of a Director's Decision.
The Petitioner's request has been granted in that the NRC staff has evaluated the majority of issues raised in the CAN Memoranda to see if further enforcement action is warranted. The conclusion of the evaluation is that no further enforcement action is warranted for those issues and LERs that have been closed by the NRC staff.
For the three LERs that are still open and being evaluated, the need for enforcement action will be considered through the inspection / enforcement 3rocess as explained in the enclosed Partial Director's Decision. The t1ree open LERs will be addressed in a Final Director's Decision after the staff has completed its evaluation.

- A copy of the Partial Director's Decisicn will be filed with the Secretary of the Commission for the Commission to review in accordance with 10 CFR 2.206(c). As provided for by this regulation, the Decision will become the final action of the Commission 25 days after its issuance, unless the Commission, on its own motion, institutes a review of the Decision within that time.
I have also enclosed a copy of the notice of " Issuance of Partial Director's Decision Under 10 CFR ?.206." which contains the complete text of DD-97 25 This notice is being filed with the Office of the Federal Register for publication.
