NRC INSPECTION REPORT NOS. 50-424/97-03 AND 50-425/97-03

Dear Mr. McCoy:

This responds to your letter of September 25, 1997, wherein you disputed a

- Notice of Violation 'ssued on June 25. 1997. for a violation of 10 CFR Part 26

- disclosure provisions, specifically 10 CFR 26.29(b). The violation alleged that a licensee employee inappropriately disclosed personal information to a union representative.

In your response, you argued that under federal law a union re)resentative is a " representative" within the context of 10 CFR 26.29(b) for tie purpose of collective bargaining and adjustment of grievances, and that a union representative was acting in that role in this matter.

While an employee may specifically designate a representative, including a union representative, to be the recipient of information protected by 10 CFR 26.29.. there is no evidence in this case of the employee's consent or '

other specific authorization prior to the union representative's receipt of the information at issue. The regulation *s purpose is the protection of highly personal information.- and consent or other specific authorization from an affected-individual is needed prior to release of such information to a -l

' representative."

The NRC notes that in this matter, a number of meetings were held over a ten-day period from December 20-30. 1996, involving the affected employee, union representatives and licensee employees. In none of these meetings were drug test results apparently. discussed. This evidences a recognition on the part of those involved that such information either was not to be disclosed or was not needed-to be disclosed or both.

After coordination between Region II, the Office of Enforcement, and the Office of General Counsel, the NRC has determined that we do not accept the assertion that the company was obligated to reveal drug test results to the union representative in this matter.. In the absence of consent or other specific authorization regarding the release of drug test results by the employee, the Notice of Violation will remain as issued. In accordance with 10.CFR 2.201, you are required to provide a response to the Notice of Violation as stated in the Notice of Violation transmitted with NRC Inspection
