FALLS CITY, TE MS S:TE OBSERVATIONAL WORK PLAN

Dear Mr. Rael:

The U.S.-Nuclear Regulatory Commission stale has reviewed the U.S. Department of Energy's (DOE's) Site Observational Wrk Plan (S0WP). dated May 1997 for the Uranium Mill Tailings Remedial Action Project site at Falls City. Texas.

The review focused on the proposed ground-water cleanup strategy 'ar demonstrating compliance with 40 CFR 192. and the presented tech... cal information to suppo't this strategy.

This review does not imply a concurrence in the ground water cleanup activities at the Falls City site, but is provided as a " fatal flaw" review of the proposed compliance strategy, based on newly collected groundwater data and analyses presented in the final S0WP.

Since completing construction of the tailings disposal cell at the site. DOE has installed twelve additional monitoring wells to delineate the extent of existing milling related contamination and performed two additional rounds of sampling and laboratory analyses.

DOE indicated that these additional well installations and analyses were conducted to address data gaps identified in the initial 50WP and Baseline Risk Assessment.

DOE proposes no remediai action at the Falls City site, because the u)permost aquifer meets the limited use classification in accordance with 40 CFR 192.

Subpart C.

The limited used determination is based on wide-saread ambient contamination not related to milling operations. that cannot )e readily treated by water-treatment technologies typically used in the region.

DOE committed to preserving any beneficial uses of the limited-use aquifer, which have been identified as limited livestock watering and irrigation.

DOE also affirmed that groundwater monitoring will continue to be performed at the site as part of the Long-Term Surveillance Program and additional wells (if needed) could be added to the monitoring to ensure protection of yp b b benef:cial uses.
