SUBJECT: NRC INSPECTION REPORT 50-454/98004(DRS); 50-455/98004(DRS) AND

NOTICE OF VIOLATION

Dear Mr. Kingsley:

This refers to the inspection conducted on January 20 through February 10,1998, at the Byron

Units 1 and 2 reactor facilities. The enclosed report presents the results of this inspection.

The inspection involved examination of engineering, technical support and self assessment

activities. The team evaluated the effectiveness of your engineering and technical support

l groups in identifying, assessing and resolving technical issues. The team also evaluated your

self assessment and corrective action processes. The team reviewed the adequacy of the

design, installation and testing of selected modifications, safety evaluations, root cause

analysis, trending and corrective action programs and their implementation.

While technical performance in engineering was generally very good in the areas reviewed,

problems were identified in the control of design changes. In addition, concerns were noted in

the corrective actions to address instruments found consecutively out of tolerance and in your

fire protection program. Self assessments were generally effective, with improvement needed

in the area of design engineering. Some selfidentified issues were not adequately followed up.

l Based on the results of this inspection, the NRC has determined that five violations of NRC

requirements occurred. These violations are cited in the enclosed Notice of Violation (Notice)

I and the circumstances surrounding them are described in detail in the subject inspection report.

The subject violations involve: (1) Inadequate process for independent verification of field

installations of Exempt Changes (modifications); (2) ineffective corrective actions, relating to out

l of tolerance instrument calibrations and modifications; (3) failure to update and maintain the

pre-fire plans to meet Appendix R requirements and NRC branch technical position

l CMEB 9.5-1, Appendix A commitments; (4) failure to conduct the annual physical examinations '

l required for fire brigade qualifications; and (5) failure to provide adequate design control

'

l measures for a design change modification.
