Dear Mr. Del Core:
I am responding to your letter dated February 5,1998, to Chairman Shirley Ann Jackson, regarding a letter dated January 23,1998, from Mr. Lanning of the U.S. Nuclear Regulatory
. Commission (NRC) to Mr. Bowling of Northeast Utilities. You indicated that Mr. Lanning's letter
.was in direct conflict with statements made by Chairman Jackson during a press conference while at Millstone on February 2,1998.
I believe you are referring to the Chairman's following statements, *l have reminded the NRC staff, and the licensee, not to be driven by schedule - but by the primary task of determining whether the Millstone organization is functioning with the proper perspective for operation," and "As I state at each Commission meeting, the Commission does not presuppose that any of the three plants will restart by any certain date." To respond to your concern, the staff does not schedule inspections to support any predetermined restart date. Our inspections are being scheduled to follow the licensee's own determination that they have completed appropriate corrective actions. To ensure the effective and efficient use of NRC resources, we are appropriately coordinating our inspection schedule with the licensee. This coordination is intended to minimize any potential adverse impacts which could result from any unnecessary delays in our inspection activities.
One purpose of NRC Manual Chapter 0301," Coordination of NRC Visits to Commercial Reactor Sites," is to ensure that NRC Inspections do not adversely impact plant operations or other major licensee planned activities. Guidance in MC 0301 is intended to limit major NRC inspection activities in a manner that both facilitates NRC's regulatory objectives and limits adverse impacts to licensee activities. Due to previously scheduled inspections, and the slippage of the licensee's schedule, it was apparent that several major inspections were going to occur at the same time. Therefore, the January 23,1998, letter was used to inform the licensee of our upcoming inspections and to obtain feedback concerning any regulatory impact these inspections could impose. If the licensee had indicated an inability to support these inspections, as scheduled, the NRC staff would have considered postponing some inspection activities. Accordingly, our scheduling efforts are important and complementary to our primary objective of a thorough assessment of the issues at Millstone.
