SUBJECT: NRC INSPECTION REPORTS 50 454/97016(DRS); 50-455/97016(DRS) AND

NOTICE OF VIOLATION

Dear Mr. Graesser:

On September 18,1997, the NRC completed a special inspection at your Byron Generating

Station, Units 1 and 2. The purpose of the inspection was to assest information regarding the

UFSAR emergency operating procedure (EOP) operator response time limits.

in general, your staff's identification of the procedural discrepancy for the steam generator tube

rupture EOP and the associated actions to resolve the problem were considered satisfactory,

it was also noted that an EOP operator response time issue was being reviewed by your staff in

conjunction with a task force. The task force was organized to evaluate all the major licensing

basis (UFSAR) operator action time requirements, and to ensure that the plant procedutos and

training were adequate.

Based on the results of this inspection, the NRC has determined that a violation of NRC

requirements occurred. Our review identified a failure to notify the NRC of issues pertaining to

EOP procedural discrepancies and the potential to exceed UFSAR operator response time

limits. The failure to notify the NRC of these issues had existed since February 19,1996, Of

concern is that your staff concluded that emergency procedure inadequacy was not significant

enough to warrant a notification to the NRC. We understand that your staff and the task force

are continuing to investigate and develop comprehensive corrective actions.

The violation is cited in the enclosed Notice of Violation. The circumstances pertaining to the )/

violation are described in detailin the enclosed report. The violation is of concern because of /

the safety significance of EOPs and the potential generic implications. Please note that you are '

required to respond to this violation and should follow the instructions specified in the enclosed

Notice when preparing your response. The 'NRC will use your response, in part, to determine

whether further eriforcement action is necessary to ensure compliance with regulatory

requirements.
